{"id":72833,"date":"2014-08-26T02:42:15","date_gmt":"2014-08-26T05:42:15","guid":{"rendered":"https:\/\/novait.com.ar\/iulianodemo\/defensa-o-ataque-hoy-nace-el-repsal\/"},"modified":"2014-08-26T02:42:15","modified_gmt":"2014-08-26T05:42:15","slug":"defensa-o-ataque-hoy-nace-el-repsal","status":"publish","type":"post","link":"https:\/\/novait.com.ar\/iulianodemo\/defensa-o-ataque-hoy-nace-el-repsal\/","title":{"rendered":"DEFENSA O ATAQUE: HOY NACE EL REPSAL"},"content":{"rendered":"<p>\u00a0<\/p>\n<p><span style=\"font-size: 12pt; font-family: verdana, geneva; color: #0000ff;\">El REPSAL ser\u00e1 el Registro de Empleadores que violan las normas laborales.<\/span><\/p>\n<p><span style=\"font-size: 12pt; font-family: verdana, geneva;\">La ley 26.940, a\u00fan no reglamentada, llamada de promoci\u00f3n del empleo registrado, adem\u00e1s bonifica las cargas sociales de los empleadores que tomen personal nuevo.<\/span><\/p>\n<p><span style=\"font-size: 12pt; font-family: verdana, geneva;\">En sus Art. 16, 39 y 46, dice que el 26 de agosto de 2014 nacer\u00e1n: la Unidad Especial de Fiscalizaci\u00f3n del Trabajo Irregular (UEFTI), con el objeto de analizar, investigar y evaluar todas las formas de subcontrataci\u00f3n ilegal y fraude laboral y a la seguridad social y el Registro P\u00fablico de Empleadores con Sanciones Laborales (REPSAL) que incluir\u00e1 y publicar\u00e1 las sanciones firmes que hayan sido impuestas en raz\u00f3n de violaciones legales cometidas.<\/span><\/p>\n<p><span style=\"font-size: 12pt; font-family: verdana, geneva;\">Ser\u00e1 una especie de \u201cVeraz\u201d p\u00fablico, que limitar\u00e1 el acceso a cr\u00e9ditos en Bancos P\u00fablicos y a Subsidios o Licitaciones con el Estado. La nueva Ley, adem\u00e1s, aumenta las multas, establece otras sanciones y a\u00fan no est\u00e1 reglamentada.<\/span><\/p>\n<p><span style=\"font-size: 12pt; font-family: verdana, geneva;\">Este nuevo registro, ha nacido como una excelente idea para denunciar p\u00fablicamente a quienes explotan, abusan, discriminan o incumplen con los trabajadores.<\/span><\/p>\n<p><span style=\"font-size: 12pt; font-family: verdana, geneva;\">El problema es que ha sido convertido por esta Ley, en un instrumento en manos de funcionarios p\u00fablicos que no tienen claro el l\u00edmite del derecho de defensa que le corresponde a empleadores que simplemente por un error formal, o de notificaci\u00f3n, o un error de declaraci\u00f3n de un empleado, o de relevamiento de un funcionario, o un fallo firme con alg\u00fan contenido ideol\u00f3gico exagerado, pueden quedar atrapados en ese Registro, por plazos de 60 d\u00edas a 3 a\u00f1os.<\/span><\/p>\n<p><span style=\"font-size: 12pt; font-family: verdana, geneva;\">Los empresas con personal en relaci\u00f3n de dependencia ingresar\u00e1n al REPSAL por:<\/span><\/p>\n<ul>\n<li><span style=\"font-size: 12pt; font-family: verdana, geneva;\">Cualquier sanci\u00f3n firme, impuesta por el Ministerio de Trabajo de la Naci\u00f3n, la AFIP, Dependencias de Trabajo Provinciales o Municipales o del Gobierno de la Ciudad, relacionadas con la falta o defectuosa inscripci\u00f3n y\/o registraci\u00f3n laboral y\/o la obstrucci\u00f3n a su control, en este \u00faltimo caso incluyendo a las ART.<\/span><\/li>\n<li><span style=\"font-size: 12pt; font-family: verdana, geneva;\">Las sentencias firmes o ejecutoriadas por las que el actor es un trabajador dependiente con relaci\u00f3n laboral desconocida o con una fecha de ingreso que difiera de la alegada en su inscripci\u00f3n, de los juzgados de la Justicia Nacional del Trabajo.<\/span><\/li>\n<li><span style=\"font-size: 12pt; font-family: verdana, geneva;\">En los casos en que el empleador acredite la imposibilidad f\u00e1ctica o jur\u00eddica de cumplir con la regularizaci\u00f3n de la conducta que gener\u00f3 la sanci\u00f3n, el infractor permanecer\u00e1 en el Registro por el plazo de noventa (90) d\u00edas contados desde la fecha de pago de la multa.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-size: 12pt;
