{"id":72383,"date":"2010-05-05T03:00:00","date_gmt":"2010-05-05T06:00:00","guid":{"rendered":"https:\/\/novait.com.ar\/iulianodemo\/laboral-dos-formalidades-importantes\/"},"modified":"2010-05-05T03:00:00","modified_gmt":"2010-05-05T06:00:00","slug":"laboral-dos-formalidades-importantes","status":"publish","type":"post","link":"https:\/\/novait.com.ar\/iulianodemo\/laboral-dos-formalidades-importantes\/","title":{"rendered":"LABORAL: DOS FORMALIDADES IMPORTANTES"},"content":{"rendered":"<div><span style=\"color: #0000ff;\">En el cese de la relaci\u00f3n laboral, extremar los recaudos y  entregar las certificaciones de servicios.<\/span><\/div>\n<div><\/div>\n<div>\n<div>Ante la ola de sentencias en contra de empresas, que las  obliga a pagar una multa de tres sueldos, por no entregar las certificaciones de  servicios, expertos advierten la necesidad de documentar legalmente que tales  comprobantes han sido puestos a disposici\u00f3n, en caso que el empleado no los  retire.<br \/>Los medios recomendados son:<br \/>* Puesta a disposici\u00f3n, en el  telegrama de despido. <br \/>* Certificaci\u00f3n de las firmas dentro del plazo  comunicado en el cese. No puede exceder los 30 d\u00edas.<br \/>* Carta Documento, si  persiste en no retirarla.<br \/>* Dejar constancia en el SECLO de la puesta a  disposici\u00f3n, si no la retir\u00f3.<br \/>* Consignar las certificaciones judicialmente,  ante la negativa a aceptarlas.<\/p>\n<p>Si a este escenario se suma que, hace s\u00f3lo  algunos d\u00edas, fue aprobada la incorporaci\u00f3n del art\u00edculo 255 bis a la LCT por el  cual los empleadores deben cancelar en un plazo m\u00e1ximo de cuatro d\u00edas h\u00e1biles la  indemnizaci\u00f3n correspondiente a un despido, resulta m\u00e1s que evidente la  importancia de que las firmas atiendan a todas estas exigencias, si no quieren  ser sancionadas.<\/p>\n<p>Como si fuera poco, se han visto en el \u00faltimo tiempo  sentencias poco entendibles, como por ejemplo aplicando multas (un empleado que  deb\u00eda cobrar $65.000 de indemnizaci\u00f3n, pero por las multas recibi\u00f3 $250.000),  castigando una suspensi\u00f3n comunicada por v\u00eda e-mail (la empleada se consider\u00f3  despedida y ahora deber\u00e1n indemnizarla), jueces que consideran \u00abpago en negro\u00bb  el uso del celular y servicio de Internet, o que es l\u00edcito \u00abchatear\u00bb en horario  laboral.<\/p>\n<p>Por todo esto debemos remarcar la importancia de tomar los  recaudos suficientes para encuadrar las relaciones laborales extremando los  cuidados
