{"id":72062,"date":"2006-10-22T03:00:00","date_gmt":"2006-10-22T06:00:00","guid":{"rendered":"https:\/\/novait.com.ar\/iulianodemo\/juicios-laborales-pedido-de-la-uia\/"},"modified":"2006-10-22T03:00:00","modified_gmt":"2006-10-22T06:00:00","slug":"juicios-laborales-pedido-de-la-uia","status":"publish","type":"post","link":"https:\/\/novait.com.ar\/iulianodemo\/juicios-laborales-pedido-de-la-uia\/","title":{"rendered":"JUICIOS LABORALES: PEDIDO DE LA UIA"},"content":{"rendered":"<div><span style=\"color: #3366ff;\">Empresarios cuestionan leyes laborales por considerarlas  \u00ablitigiosas, imprevisible e inasegurables\u00bb<\/span><\/div>\n<div>C\u00f3rdoba, oct. 20 (NA) &#8212; La Uni\u00f3n Industrial Argentina (UIA),  afirm\u00f3 que las decisiones judiciales en materia laboral se \u00abhan convertido en  litigiosas, imprevisibles para empleadores y trabajadores e inasegurables\u00bb.<\/div>\n<div>Seg\u00fan el responsable del \u00e1rea legal de la UIA, esto \u00abha causado que se hayan  triplicado los juicios y cuadruplicado -en promedio- los montos demandados\u00bb.  <br \/>Es que en el centro de la discusi\u00f3n de los empresarios, los sindicalistas y  el Gobierno est\u00e1 la Ley de Riesgos del Trabajo, que, seg\u00fan reconoci\u00f3 ayer el  ministro de Trabajo, Carlos Tomada, est\u00e1 \u00abdemorada\u00bb en la b\u00fasqueda de consensos.  <br \/>A los empresarios les preocupa sobre todo la doble v\u00eda, que pretenden que  sea excluyente, ya que buscan que quienes opten por litigar con la ART no puedan  hacerlo ante la empresa y viceversa. <br \/>A ello llaman doble v\u00eda \u00abexcluyente\u00bb.  <br \/>Por eso, seg\u00fan la UIA piden \u00abuna opci\u00f3n excluyente que d\u00e9 al trabajador la  posibilidad de elegir el r\u00e9gimen de seguro o -a su elecci\u00f3n, pero en forma no  acumulable- ir a la v\u00eda de acci\u00f3n civil ante la Justicia Civil y con sus  respectivas reglas de procedimiento y con tope de honorarios, del 25 por ciento  respondiendo la ART hasta lo que hubiera tenido que pagar por la v\u00eda de la ley\u00bb.  <br \/>Se\u00f1al\u00f3 que pretenden tambi\u00e9n \u00abmontos indemnizatorios realistas para el  trabajador y asegurables para el empleador\u00bb. <br \/>\u00abNo puede equipararse la  responsabilidad del empleador por el accidente in itinere con el monto que  resulta de la aplicaci\u00f3n del caso Vuotto, que s\u00f3lo deber\u00eda aplicarse en caso de  riesgo o vicio de la cosa\u00bb, evalu\u00f3 el especialista durante su exposici\u00f3n en la  convenci\u00f3n anual de la UIA en C\u00f3rdoba. <br \/>Por eso, consider\u00f3 que \u00abel empleador  debe responder exclusivamente, en el marco de la Ley de Riesgos del Trabajo y  hasta un monto razonable\u00bb. <br \/>\u00abEl listado de enfermedades no puede abrirse en  forma irrestricta, ni admitirse la concausa.
